Non-Exclusive Commercial Recording Contract&lt;/h3&gt;

Working in coordination with an Artist, Band or group the recording Master Producer's obligation is to create a song or tune of music in accordance with a vision for a single, album or CD.  The Producer controls the recording sessions, guiding and orchestrating the artists and musicians, organizing and scheduling the production budget and supervising the recording, mixing and mastering processes.

The modern day digitally competent Producer using her/his computer may be entirely responsible for writing, performing, recording and arranging the material. These technocrats are in many changing the role of the traditional recording studio in that with modern electronics an entire album can be created and recorded from the Producers home studio.

Employment of Minor Musicians raises special concerns because Minors can repudiate contracts.  An Employer cannot enforce a disaffirmed contract.  In hiring a minor, the Employer must also comply with provisions of the Labor Codes of the Jurisdiction and regulations of any Labor Commission.

Minors cannot perform work that is hazardous or detrimental to their health, safety, morals or education.

The Minor must have her/his contract signed by her/his Parent/Guardian.  The Minor must have a Parent or Guardian on the set or qualified supervision.

All the Rights to a piece of original music or a song are Property and as such can be bought, sold, assigned, inherited or given away.  Hence, a Composer may sell her/his/their original composition to a new Owner.

To earn a profit the Composer and/or the Owner of a piece of music or a song will need a Publisher to sell your Property.

This music legal contract includes but is not limited to the following Clauses; Royalties, copyright assignment, payment obligation dates, auditing, composer/owner ownership covenant and motion picture synchronization. Within the music industry, a mechanical license gives the holder permission to create copies of a recorded song or musical composition, a sound recording, which they did not write and/or do not have Copyright over. It is an agreement with the Copyright holder, the publisher, or the songwriter that allows the holder to reproduce the sound recording.

A mechanical license is not generally required for an artist who is recording and distributing their own work. This is also used by recording artists performing cover versions of songs and artists who do not typically write their own songs, as is typical in Country and Top 40 music.

This is an extensive six page, twenty three clause including Parent/Guardian's signature music legal contract including but now limited to the following clauses: confidentiality, drugs and alcohol, assignment of rights and performance standards.

Employment of Minor Musicians raises special concerns because Minors can repudiate contracts.  An Employer cannot enforce a disaffirmed contract.  In hiring a minor, the Employer must also comply with provisions of the Labor Codes of the Jurisdiction and regulations of any Labor Commission.

Minors cannot perform work that is hazardous or detrimental to their health, safety, morals or education.

Due to the Rights that arise on any Minor Artist reaching the age of majority an individual Agreement should be signed with each and every Minor Artist.  The Minor must have her/his contract signed by her/his Parent/Guardian.  The Minor must have a Parent or Guardian on the set or qualified supervision.

A Producer may require a Composer for a Project.  The composer-for-hire may be requested to write music and/or lyrics for a television jingle, radio music  commercial, music for a play, movies, short films, etc.

This is a comprehensively drafted twelve page, twenty-eight clause music legal contract with Clauses regarding but not limited to: confidentiality, duties of composer, services being hired, compensation or royalties, rights as to title, changes, modifications and additions, assignment, force majeure, failure to perform and dispute resolution.

The Independent Composer-for-hire is not employee, nor partner, nor agent of the Producer, nor of the Production Company nor any other company or person affiliated with the Producer in any manner whatsoever.

Signing this contract the independent Composer-for-hire is assigning any and all Rights to their work performance over to the Producer.
